Registered copyright in China
1. Is copyright registration compulsory?
No. Copyright is effective from the date of publication of the work, but registration provides a number of benefits such as the ability to sue the court or write a complaint on the marketplace, etc.
2. What can be registered as a copyright?
Literary works; musical works; dramatic works; pantomimes and choreographic works; painted, graphic and sculptural works; motion pictures and other audiovisual works; sound recordings; architectural works.
3. Is it possible to register several objects (photos, books, etc.) in one application?
Offices offer different group registrations. But the question, depending on the case, needs to be handled individually. Contact the 4B experts.
4. How long is my copyright registration certificate valid?
In general, the term is the author’s whole life plus 70 years from the date of publication of the work. Some exceptions apply to works published under contract or under a pseudonym, but for those cases the term is also substantial and amounts to about 100 years depending on certain conditions.
5. Do I need to ask for permission to include part of someone else’s work in a registered work?
Examination for the most part does not check for the presence of extraneous works in the claimed work, but we recommend obtaining the appropriate permissions before registering.
6. Can anyone use my registered work without my permission?
Yes, there are several cases in which it is not necessary to obtain such permission from the copyright holder: informational, educational, scientific, survey purposes, etc.
7. Can I change the work and register it?
No, the right to derivative works (for example, a translation of a book or a print of a famous picture on a T-shirt) belongs to the author of the original work.
8. What should I do if someone has violated my rights to my registered work?
There are many ways to stop the infringement and/or get compensation, from complaining on an online platform to filing a lawsuit in court.
The most popular on the Internet is a notice-and-takedown procedure with the Internet service provider – in most jurisdictions around the world, laws set deadlines for the Internet service provider to review such complaints.
9. What is the average fine for copyright infringement?
Of course, the amount of fine depends on many factors – the cost of the work in the market, the amount of effort put into creation of the work, etc.
Copying an ordinary photo from a non-authoritative site with a caption like “free photos,” the infringer can then receive a fine of $750 from the actual copyright holder.
For more substantial infringements, fines can reach tens or hundreds of thousands of dollars.
10. Can I search for registered works?
Yes, but it is not very informative. It is possible to see the title, author, date of publication and creation, but not the work itself.
